RATIONALE/OBJECTIVE:
Building and construction for the Cobb County
School District (District) shall be done on a legal contract basis between
the contractor and the District.
RULE:
A. GENERAL PROVISIONS:
1. The time required for the substantial and final completion
of each construction project
and liquidated damages amounts shall
be stated in all contract specifications.
2. The use of Time and Material Contractors will be utilized
on small projects and those
projects where time is of the
essence.
B. CONTRACTS FOR CONSTRUCTION:
1. Contracts for construction shall be executed on the
appropriate, current edition of
the American Institute of Architects
Construction Contract forms. The construction
contract will be reviewed and
modified, as needed, by the Board Attorney.
2. Construction Contracts will be approved in accordance with
the following:
a. Contracts in the amount of $25,000
or less shall be approved by the
Superintendent or the Chief Operation Officer and executed by the
Superintendent
or designee.
b. Contracts in the amount of $25,001
to $200,000 will be approved by Coordination
Record and
executed by the Superintendent or designee.
c. Contracts in excess of $200,000
will be recommended by the Superintendent and
approved by
the Board of Education. Superintendent or designee to execute
contract.
3. Time for completion and liquidated damages may be omitted
from contract
specifications for projects costing
less than $25,000.
4. The Superintendent or designee is authorized to grant
construction contract time
extensions. The Superintendent shall
recommend to the Board of Education any
extension of contract time in excess
of the time extension authorized to be granted
by the Superintendent.
5. The Superintendent is authorized to grant an equitable
time extension for the
number of days allowed for abnormal
weather in accordance with the provisions of
the approved construction contract.
6. Cobb County Board of Education shall approve all annual
time and material
contractors. Time and Material
projects between $25,000 to $50,000 shall be
reported to the Board of Education
and time and material projects exceeding $50,000
shall require prior approval from the
Board of Education.
