Loitering KFA 12/9/04


RATIONALE/OBJECTIVE:

The Cobb County School District recognizes concerns for the welfare of students from their entry on a school bus or school property to their return to the bus stop or when they leave school property. Part of that responsibility is to assure that students and staff are not distracted from the task of learning by the presence on campus of unauthorized individuals.

RULE:

It shall be unlawful for any person to remain upon the premises of any Cobb County School District public school or within the school safety zone when that person does not have a legitimate cause and/or need to be present thereon, and it shall be further unlawful for any person to loiter upon the premises of any Cobb County School District public school or within the school safety zone.

Pursuant to state law:

A. Each principal or designee shall exercise such control over the buildings and grounds upon which a school is located so as to:

1. Prohibit any violation of the above, and

2. Notify the appropriate law enforcement agency to prohibit any person who does not have a legitimate need or cause to be present therein from loitering within the school safety zone.

B. The school safety zone means in, on, or within 1,000 feet of any elementary, middle, or high school grounds owned by the Cobb County Board of Education.

C. No person shall be allowed to remain upon the premises of any Cobb County School District public school after normal school hours or after normal activity hours without the express written consent of the Superintendent or his/her designee.

D. School personnel shall ask persons loitering to leave school grounds. Persons who refuse to leave are subject to criminal prosecution under the laws of the State of Georgia.
