Certificates of Attendance Requirements
Please read carefully!
As a result of House Bill 1190, the Department of Driver’s Services (DDS) has revised the School Certificate of Attendance requirements. This revision is necessary to comply with changes in the law. Please note the following changes that reflect the new forms and requirements:
- Removes the ability for a student under age 18 to withdraw from school with parent consent and still be eligible to drive.
- Requires a person who is younger than 18 years of age to be enrolled in and not under suspension from a public or private school for a period of one (1) academic year prior to application for an instruction permit or driver’s license.
- Requires a student have no more than 10 unexcused absences in school year for a period of one academic year prior to applying for an instruction permit or driver’s license.
DDS will not issue OR will now suspend the license if the student:
- Has dropped out of school without graduating and has remained out of school for 10 consecutive school days (Student under 18 years of age.)
- Has more than 10 school days of unexcused absences (these do not have to be consecutive) in any semester.
- Has been suspended from school for any of the following reasons:
- Threatening, striking, or causing bodily harm to a teacher or other school personnel.
- Possession or sale of drugs or alcohol on school property.
- Possession or use of weapon on school property.
- Any sexual offense prohibited under Chapter 6 of Title 16.
- Causing substantial physical or visible bodily harm to or seriously disfiguring another person, including another student.
The suspension shall be for a period of one year or shall end upon the date of the minor’s 18th birthday, which ever comes first.
